Terms of Service
1. Introduction
These Terms of Use (“Terms”) govern your use of the Newzy platform (app.newzy.eu). Newzy e.U. owns Newzy and is referred to in this document as the “Owner.”
2. User Accounts
Registration: Registration is open to everyone.
Security: Users are responsible for the security of their login credentials.
Termination: Users can delete their account themselves at any time via the platform or terminate it in writing by email to hello@newzy.eu. Accounts may be terminated immediately in the event of violations (e.g., illegal content or prohibited activities).
3. Service Description
Pro Plan: Newzy offers free basic access with limited functionality. No cancellation is required, as there is no contractual obligation.
Team Plan: Newzy is available by invitation with unlimited functionality for a fee.
Enterprise Plan: Newzy offers a paid plan for businesses with unlimited functionality and customized service periods.
4. Term and Termination
(1) Pro Plan and Team Plan
The Pro Plan and Team Plan automatically renew for the respective service period. The customer may terminate the contract without notice at the end of the current service period via the application or by email to hello@newzy.eu. Refunds of payments already made are not issued.
(2) Enterprise Plan
The Enterprise Plan runs for the service period agreed upon in the contract and terminates automatically upon its expiration without requiring notice of termination.
The customer may terminate the contract prematurely with 30 days' notice to the end of a calendar month by sending written notice via email to hello@newzy.eu. In this case, Newzy will refund the pro-rata amount attributable to the unused portion of the remaining term within 30 days of the termination taking effect.
The right of both parties to extraordinary termination for good cause (§ 918 ABGB) remains unaffected.
5. Intellectual Property
Ownership: All software, trademarks, and platform content (excluding user-generated content) are the property of the owner of Newzy.
License for User Content: Users retain ownership of their own content. By using Newzy, users grant the owner of Newzy a non-exclusive, royalty-free license to store, process, and display their content solely for the purpose of providing the service.
6. Prohibited Activities
Illegal Content: Users may not distribute, create, or share illegal content. This includes, in particular, hate speech, incitement to violence, or discrimination, which are prohibited under Austrian law (including, but not limited to, Section 283 of the Austrian Criminal Code, the Prohibition Act, and other applicable Austrian anti-discrimination and criminal laws).
Disinformation: Users may not create or share disinformation (deliberately false information) that is likely to cause harm to the public, as defined in EU and Austrian standards.
Hacking: Users may not hack, spam, or scrape the platform without authorization.
7. Limitation of Liability
The service is provided "as is" and without warranty. Newzy e.U. is liable without limitation for intent and gross negligence, as well as for breaches of essential contractual obligations. The liability of the owner of Newzy is limited to a maximum of €1,000, or to the amount of fees paid in the last 12 months, to the extent permitted by law.
8. Applicable Law and Dispute Resolution
Applicable Law: These Terms of Use are governed by Austrian law, in particular the Austrian Civil Code (ABGB) and the Austrian Criminal Code (StGB).
Jurisdiction: For disputes between Newzy and businesses (B2B), Vienna, Austria, is the exclusive place of jurisdiction. For consumers (B2C), the statutory place of jurisdiction under EU law applies (Art. 18 Brussels I Regulation).
9. Changes to the Terms of Use
The owner may change these Terms of Use at any time. Changes will be communicated to users at least 30 days before they take effect via email or in-app notification. Continued use of the service after the changes take effect constitutes acceptance. If the user does not agree to the changes, they may terminate the contract with due notice.
